Iain Tyrrell Benson is an internationally recognized legal scholar, philosopher of law, practicing legal consultant, writer, poet and musician. Born in Edinburgh, Scotland, he grew up primarily in Canada, where his early education and intellectual development began before he went on to become a leading voice in legal philosophy, constitutional law, human rights and the theory of pluralism.
Early Life & Education Benson was born in Edinburgh and raised in Canada, where he completed his schooling and pursued higher education. He earned a BA (Honours) in English Literature from Queen’s University, followed by a JD (Juris Doctor) from the University of Windsor. He then studied law at St Catharine’s College, Cambridge (MA), and completed a PhD in law at the University of the Witwatersrand in South Africa with a thesis focused on rights, religion and legal pluralism. Academic & Professional Career Benson’s career spans legal practice, academia, and public policy: He practised law in Canada, serving as a barrister, solicitor and senior counsel before moving into academic life. He has held faculty positions including Professor of Law at the University of Notre Dame Australia (Sydney) and Extraordinary Professor of Law at the University of the Free State in South Africa. In 2025 he also served as a Visiting Professor in the School of Roman Law at Jagiellonian University in Poland. Benson has written and lectured widely on constitutional law, human rights, legal ethics, the nature of secularism, pluralism and freedom of religion. His scholarly work is notable for rigorous conceptual analysis of terms like pluralism, secularism, belief and accommodation in law.
His work has been cited by major courts including the Supreme Court of Canada and the Constitutional Court of South Africa. He was also involved in drafting the South African Charter of Religious Rights and Freedoms and has served as an expert advisor on matters of religion, law and public policy internationally. Writing & Intellectual Contributions Benson is the author and editor of numerous academic articles, book chapters and books. One of his notable works is Living Together with Disagreement: Pluralism, the Secular and the Fair Treatment of Beliefs in Law Today. He is also a co-editor of The Cambridge Handbook of Natural Law and Human Rights and has contributed to widely cited literature on human rights and law.
His work often explores how legal and political systems can fairly accommodate diverse beliefs — religious and non-religious — in modern pluralistic societies. Artistic & Personal Life In addition to his academic career,
Benson is a published poet and engaging musician. He plays the penny whistle and harmonica, and has recorded music on several albums, particularly on the Die Wasgoedlyn label produced by Riku Latti. He has also edited critical editions of works by G.K. Chesterton and contributes to cultural and literary discussions.
Benson is a Roman Catholic and a dedicated family man with seven children and several grandchildren.
